Confidentiality and use terms for email correspondence from Rijker Advisory.
Scope
These terms apply to all email correspondence originating from Rijker Advisory, including emails, attachments, links, and other electronic communications sent from an email address within the rijkeradvies.nl domain.
Confidentiality and use
Email correspondence from Rijker Advisory is confidential and intended solely for the addressee(s). Unauthorised access, use, distribution, reproduction, or forwarding to third parties outside the circle of addressees is not permitted.
This correspondence may be subject to a contractual confidentiality obligation, including but not limited to obligations under an engagement, a non-disclosure agreement, or Article 12 of Rijker Advisory's General Terms and Conditions. The content is further protected by copyright under Article 1 of the Dutch Copyright Act. Unauthorised disclosure or reproduction is prohibited under the Copyright Act, without prejudice to Article 11 of the General Terms and Conditions regarding intellectual property.
Unauthorised distribution may, in certain circumstances, constitute an unlawful act within the meaning of Article 6:162 of the Dutch Civil Code, in particular where such distribution breaches a confidentiality obligation, harms a legitimate interest of Rijker Advisory or of any third party concerned, or causes damage.
Processing of personal data
To the extent that personal data are processed in the correspondence, such processing takes place in accordance with the General Data Protection Regulation (GDPR) and the Dutch GDPR Implementation Act (UAVG). Any further processing or transfer of these personal data by the addressee(s) or by third parties must take place within the limits of the GDPR and under the independent responsibility of the party concerned. Receipt in error
If you have received this correspondence in error, you are requested to notify Rijker Advisory immediately at rion@rijkeradvies.nl and to destroy the correspondence and any attachments without storing, copying, or sharing them.
General Terms and Conditions and liability
All services and activities of Rijker Advisory are governed by the General Terms and Conditions, filed with the Dutch Chamber of Commerce under number 70443718 and available at rijkeradvies.nl/en/legal/general-terms. The General Terms and Conditions include, among other things, a limitation of liability clause (Article 14) and provisions on intellectual property (Article 11) and confidentiality (Article 12).
Governing law
This Email Disclaimer and all correspondence from Rijker Advisory are governed by Dutch law. Disputes shall be submitted exclusively to the competent court in the district of Amsterdam, without prejudice to the General Terms and Conditions.
